We recently advised a client who had to reapply for planning permission as it had lapsed due to the failure of complying with certain conditions of the planning permission. The failure to comply with these conditions was as a result of the professional negligence of his previous solicitors who had given inappropriate advice. Following the Professional Negligence Pre-Action Protocol, we sent a Letter of Claim to the previous solicitors who accepted that they were negligent but denied liability as to the loss caused to our client. After obtaining further evidence, we were able to secure a substantial payment for our client.
